- Scope and provider
1.1 These Terms govern the use of the website carenzzo.com and all its language versions (the „Website”), operated by Carenzzo LLC, Ukraine, registered under 357865 („Carenzzo”, „we”, „us”).
1.2 By using the Website you accept these Terms. If you do not accept them, please do not use the Website.
1.3 Use of the Website is free of charge for users.
- Role of Carenzzo
2.1 Carenzzo operates a comparison and information service for car rental. We display offers made available to us by our partner Localrent and by the rental companies listed on it.
2.2 Carenzzo is not a car rental company, does not own or operate any vehicles, and is not a party to the rental agreement. The rental agreement is concluded exclusively between you and the rental company you select.
2.3 Carenzzo does not act as an agent or representative of any rental company and is not authorised to accept declarations or claims on their behalf.
2.4 Carenzzo does not combine car rental with transport, accommodation or other travel services and therefore does not offer packages or linked travel arrangements within the meaning of Directive (EU) 2015/2302.
2.5 We receive a commission from our partner when a booking is completed. This does not increase the price you pay.
- Offers, prices and availability
3.1 All information on vehicles, prices, deposits, insurance packages and rental conditions originates from the rental companies and is transmitted to us by Localrent. We display this information in the form in which we receive it and do not verify it independently.
3.2 Prices depend on dates, demand and availability and may change at any time before a booking is completed. Displayed prices are an indication and are not an offer capable of acceptance.
3.3 Vehicle images and model names illustrate the vehicle category. The rental company allocates a vehicle of the booked category or equivalent; there is no entitlement to a specific model.
3.4 We do not guarantee that the offers shown cover the entire market or that a lower price is unavailable elsewhere.
- Ranking of offers
4.1 Search results are provided by Localrent and displayed in the order determined by {ranking_parameters}.
4.2 No rental company pays for placement or for a higher position in the results.
4.3 All rental companies shown are businesses acting for purposes relating to their trade. Consumer protection law therefore applies to the rental agreement you conclude with them.
- Booking
5.1 A booking is initiated on the Website and processed by Localrent. Payment is handled by Localrent or by the rental company, not by Carenzzo. We do not receive or store your payment card details.
5.2 The rental agreement takes effect according to the terms of Localrent and of the selected rental company, which are shown to you before payment. Those terms prevail over any general description on the Website.
5.3 Booking confirmations, vouchers and invoices are issued by Localrent or the rental company.
- Rental conditions
6.1 Minimum age, required driving experience, deposit, fuel policy, mileage limits, cross-border permissions, additional drivers and extras are set by the rental company and vary between companies and vehicle categories.
6.2 Descriptions of local rules and typical rental conditions published on the Website are general information for orientation. They do not form part of any contract and may not reflect the conditions of an individual offer or subsequent changes in law.
6.3 It is your responsibility to hold a valid driving licence and any documents required in the country of rental and to comply with local traffic law.
- Cancellation, changes and right of withdrawal
7.1 Cancellation and amendment of a booking are governed by the terms of Localrent and of the rental company, which are shown before payment. Carenzzo cannot cancel, amend or refund a booking.
7.2 As no paid contract is concluded between you and Carenzzo, no right of withdrawal arises in relation to us.
7.3 Contracts for the rental of vehicles for a specific date or period are exempt from the statutory right of withdrawal under Article 16(l) of Directive 2011/83/EU. The cancellation policy of the rental company applies instead.
- Complaints
8.1 Complaints about a booking, a vehicle, a charge at the counter, a deposit or the conduct of a rental company must be addressed to Localrent or to the rental company concerned.
8.2 You may nevertheless contact us at {email}. We will forward your message to our partner where we are able to do so. This does not create any obligation for us to settle the matter or any liability for its outcome.
- Use of the Website
9.1 You may use the Website for the purpose of searching for and booking car rental.
9.2 You may not use automated means to extract data from the Website, interfere with its operation, circumvent technical measures, or use the content for competing commercial services.
- Content and intellectual property
10.1 The name Carenzzo, the logo, the editorial texts, the structure and the design of the Website are protected. Reproduction beyond what is permitted by law requires our prior written consent.
10.2 Vehicle images, brand names and supplier data belong to their respective owners and are used to identify the offers displayed.
10.3 The Website contains links to third-party websites. We have no influence on their content and accept no responsibility for it. Should you become aware of unlawful content on a linked website, please inform us and we will remove the link.
- Liability
11.1 We are liable without limitation for damage resulting from injury to life, body or health, for damage caused intentionally or by gross negligence, under mandatory product liability rules, and where we have given a guarantee.
11.2 In cases of slight negligence we are liable only for the breach of a material contractual obligation, meaning an obligation the fulfilment of which is essential for the proper use of the Website and on the observance of which you may regularly rely. In such cases our liability is limited to the damage typically foreseeable at the time the obligation arose.
11.3 We are not liable for the performance of the rental agreement by the rental company, for the condition, availability or handover of a vehicle, for charges applied at the rental counter, or for the retention or release of a deposit.
11.4 We are not liable for the accuracy, completeness or currency of data transmitted to us by our partner, save in the cases set out in 11.1 and 11.2.
11.5 We do not warrant uninterrupted availability of the Website.
- Data protection
The processing of personal data is described in our Privacy Policy at carenzzo.com/en/legal/privacy/.
- Changes to these Terms
13.1 We may amend these Terms where this is necessary for legal, technical or operational reasons.
13.2 The version published on the Website at the time of your use applies. The date of the current version is shown at the top of this page.
- Applicable law and dispute resolution
14.1 These Terms are governed by the law of Ukraine.
14.2 If you are a consumer resident in the European Union, this choice of law does not deprive you of the protection of mandatory provisions of the law of your country of residence, and you may bring proceedings before the courts of your place of residence.
- Final provisions
15.1 Should any provision of these Terms be or become invalid, the validity of the remaining provisions is unaffected.
